User Agreement
User (the “User”) can access PAYKAR.IO (the “Site”), subject to the terms and conditions of use, as changed/updated from time to time entirely at the discretion of PAYKAR.IO as set out below. The term of this Agreement shall continue and would be in force till the time User access this site & its services and User agree that User are bound by the terms and conditions as mentioned herein. Nothing in these Terms of Service should be construed to confer any rights on User or any third party beneficiaries.

Eligibility & Registration
User must be 18 years or older to use the services of PAYKAR.IO. By registering/visiting/signing up the PAYKAR.IO service, User represent and warrant that User are 18 years or older and that User have the capacity to understand, agree to and comply with these Terms of Service. Since Indian laws do not permit us to contract with a minor person (minor is a person who has not completed 18 years of age), we do not market our Web site to minor person under the age of 18. However, a minor can apply for various services offered by PAYKAR.IO under the supervision and guidance of guardian.

All Information provided by the applicant should exactly and completely match the details present on the document proofs submitted. Any Discrepancy in the Documents Attached and/or Application Form filled will be sole responsibility of the User and PAYKAR.IO will not be liable to pay any refund amount back to the user in case of any such discrepancy or any issues that may arise due to such discrepancy.

Changes To Terms And Conditions
We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend/cancel, or discontinue any or all service at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. Such changes will be posted to PAYKAR.IO for your convenience to understand your responsibility as a user. Users are responsible for regularly reviewing these Terms of Service so that User will be apprised of any changes. User will be deemed to have accepted such change/s if User continue to access the Site subsequent to such changes.

Prohibited Conduct
By accessing or using the PAYKAR.IO Platform or by availing PAYKAR.IO Services, User agree not to:

1. Violate the T&Cs;
2. Impersonate any person or entity, falsely claim or otherwise misrepresent Your affiliation with any person or entity, or access the accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity, or content of information transmitted via the PAYKAR.IO Services, perform any other similar fraudulent activity or otherwise avail PAYKAR.IO Services with what we reasonably believe to be potentially fraudulent funds;
3. Infringe our or any third party’s intellectual property rights, rights of publicity or privacy;
4. Use the PAYKAR.IO Services if User are under the age of 18 years without a parental sponsor or, in any event, use the PAYKAR.IO Services if User are under the age of 13 years old even with a parental sponsor and in accordance with applicable law;
5. Post or transmit any message which is libelous, defamatory or which discloses private or personal matters concerning any person;
6. Post or transmit any message, data, image or program which is pornographic, vulgar or offensive in nature;
7. Refuse to cooperate in an investigation or provide confirmation of Your identity or any other information provide by User to PAYKAR.IO;
8. Remove, circumvent, disable, damage or otherwise interfere with security-related features of the PAYKAR.IO Services and the PAYKAR.IO Platform or features that enforce limitations on the use of the PAYKAR.IO Services or the PAYKAR.IO Platform;
9. Reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of as regards PAYKAR.IO Services or PAYKAR.IO Platform or any part thereof, except and only to the extent this is expressly permissible by applicable law;
10. Use the PAYKAR.IO Services or the PAYKAR.IO Platform in any manner that could damage, disable, overburden, or impair it, including, without limitation, using the PAYKAR.IO Services or the PAYKAR.IO Platform in an automated manner;
11. Modify, adapt, translate or create derivative works based upon the PAYKAR.IO Services and the PAYKAR.IO Platform or any part thereof, except and only to the extent that that this is permissible by applicable law;
12. Intentionally interfere with or damage operation of the PAYKAR.IO Services or the PAYKAR.IO Platform or any other user’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code or file with contaminating or destructive features;
13. Use any robot, spider, other automatic device, or manual process to monitor or copy the PAYKAR.IO Platform without prior written permission;
14. Interfere or disrupt the PAYKAR.IO Platform or networks connected to the PAYKAR.IO Platform;
15. Take any action that imposes an unreasonably or disproportionately large load on PAYKAR.IO’s infrastructure/network;
16. Use any device, software or routine to bypass the PAYKAR.IO Platform’s robot exclusion headers, or interfere or attempt to interfere, with the PAYKAR.IO Services;
17. Forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through the PAYKAR.IO Platform or to manipulate Your presence on the PAYKAR.IO Platform;
18. Sell the PAYKAR.IO Services, information, or software associated with or derived from it;
19. Use the facilities and capabilities of the PAYKAR.IO Platform to conduct any activity or solicit the performance of any illegal activity or other activity which infringes the rights of others;
20. Breach this Agreement, the SSOID Agreement or any other agreement or policy as may be applicable pursuant to the T&Cs;
21. Provide false, inaccurate or misleading information;
22. Use the PAYKAR.IO Platform to collect or obtain personal information, including without limitation, financial information, about other users of the PAYKAR.IO Platform, except and only as expressly provided in the T&Cs;
23. Avail PAYKAR.IO Services with what PAYKAR.IO reasonably believes to be potentially fraudulent funds;
24. Use the PAYKAR.IO Services in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and other liability to PAYKAR.IO, a third party or User;
25. Use the PAYKAR.IO Services in a manner that PAYKAR.IO or any payment card network reasonably believe to be an abuse of the payment card system or a violation of payment card network rules;
26. Send automated request of any kind to the PAYKAR.IO Platform without express permission in advance from PAYKAR.IO.

Information Collected
PAYKAR.IO will only collect, store, use, and share Your personal information (including email address) as it is defined by our Privacy Policy and as regulated by Indian laws.

1. a) It is being accepted by the User that the contact information is collected and used by the company to provide services opted for, which is provided by the User from time to time on Website. The User’s need is fulfilled accordingly. This information is used by the Website/Company to improve the services for the User by providing regular updates.
2. b) There is certain information which maybe tracked automatically by the Company/Website about the User like User’s IP address and User’s behavior on Website. The User knows that such information may include the URL that the User visited prior to accessing the Website, the URL which the User subsequently visits (whether or not these URLs form a part of the Website), the User’s computer & web browser information, the User’s IP address, etc.
3. c) If any User Chooses to buy any product or services from the Company/Website, the User is allowing the Company/Website to gather the personal information of the User.
4. d) The User is aware that if any information which is provided by User whether it is posted message/ review / feedback anywhere on Website can be used by the Company/Website to help out the User in every possible way in future. This retained information can be used to resolve disputes, provide customer support, troubleshoot problems with such information, if requested, may be provided to judicial or governmental authorities of requisite jurisdiction, or otherwise used by the Company/Website as permitted by applicable laws.
5. e) The Company/Website can ask or request the User to provide the reviews for the products/services which are purchased/ availed by the User from Website.
6. f) The information like content/reviews/surveys/feedback which is submitted by the User to Company/Website may or may not be stored, uploaded, published or displayed in any manner. The User authorizes the Website/Company to remove any such content, review, survey or feedback from Website which has been submitted by User, without cause or being required to notify the User of the same.

Any information which is specifically mentioned by PAYKAR.IO as Confidential shall be maintained confidentially by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.

User Account/Data Deletion and De-Activate/Re-Activate
A request to delete of user’s account will not be entertained as we are bound to keep the customer’s data and transaction history as per RBI Guidelines. A user can raise a request for De-Activation of his/her account by mailing us at [email protected] from the registered email ID. After we receive the request, our team will take up to 72 working hours to De-Activate the account after which the user shall not be able to use any of our platforms (Website/Application). To Re-Activate the account, the user needs to email us at [email protected] from the registered email ID. Once our team evaluates the authenticity of the request then only shall the account be Re-Activated.

Fees Payment
PAYKAR.IO reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. PAYKAR.IO further reserves the right to alter any and all fees from time to time, without notice.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.

In case, there is a short charging by PAYKAR.IO for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.

Any increase in the price charged by Company on account of change in rate of taxes or imposition of new taxes by Government shall have to be borne by customer.

In the rare possibilities of the reservation not getting confirmed for any reason whatsoever, we will process the refund and intimate User of the same. PAYKAR is not under any obligation to make another booking in lieu of or to compensate/ replace the unconfirmed one. All subsequent further bookings will be treated as new transactions with no reference to the earlier unconfirmed reservation.

The User shall request PAYKAR for any refunds against the unutilized or ‘no show’ air or hotel booking for any reasons within 90 days from the date of departure for the air ticket and/or the date of check in for the hotel booking. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, hotels and PAYKAR as the case may be. No refund would be payable for any requests made after the expiry of 90 days as above and all unclaimed amounts for such unutilized or ‘no show’ air or hotel booking shall be deemed to have been forfeited.

Usage Of Mobile Number
PAYKAR.IO may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking; PAYKAR.IO may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by PAYKAR.IO is (a) upon the request and authorization of the User, (b) ‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify PAYKAR.IO against all types of losses and damages incurred by PAYKAR.IO due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on PAYKAR.IO with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

Onus Of The User
PAYKAR.IO is responsible only for the transactions that are done by the User through PAYKAR.IO. PAYKAR.IO will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction. The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.

Credit Report
I hereby appoint PAYKART TECHNOLOGIES PRIVATE LIMITED as my authorized agents/representatives for the collection of my Credit Information Report. I hereby give my free consent and authorize PAYKART TECHNOLOGIES PRIVATE LIMITED by providing my personal information to obtain my Credit Information Report and Credit Score from Experian Credit Information Services Pvt. Ltd. (‘Experian) & CRIF High Mark Credit Information Services Pvt. Ltd. (‘CRIF’) for the purpose of risk assessment and credit underwriting and not for any other purpose.

Advertisers On Paykar.io Or Linked Websites
PAYKAR.IO is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. PAYKAR.IO does not endorse any advertiser on its web pages in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

The linked sites are not under the control of PAYKAR.IO and PAYKAR.IO is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. PAYKAR.IO is providing these links to the Users only as a convenience and the inclusion of any link does not imply endorsement of the site by PAYKAR.IO.

Refund Policy
All services rendered by the Company are provided on a non-refundable basis. This includes, but not limited to, setup fees, monthly fees, upgrade fees and professional services fees. In addition, if your services / account are cancelled by the company for violation of this Agreement or the attached Acceptable Use Policy, all payments made to the Company become completely non refundable. Customer agrees not to charge back any payments via Credit Card/ Debit Card/ Net Banking/ Direct Transfer or any other form of payment for services rendered. In the event that a customer files a charge back or other payment dispute, they will be considered to be in violation of this agreement and may be subject to collection action.

Cancellation Policy
The Customer agree that the booking made are subject to the cancellation policy set out on the booking page or as communicated to the customers in writing.

Insurance
Unless explicitly provided by PAYKAR.IO in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation/option of the user and PAYKAR.IO doesn’t accept any claims arising out of such scenarios. Insurance, if any provided as a part of the service/ product by PAYKAR.IO shall be as per the terms and conditions of the insuring company. The User shall contact the insurance company directly for any claims or disputes and PAYKAR.IO shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.

Force Majeure Circumstances
PAYKAR.IO shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause. Force Majeure event shall be one when there is any cessation, interruption or delay in the performance of PAYKAR.IO’s obligations due to causes beyond its reasonable control, including but not limited to: technical, earthquake, flood, or other natural disaster, act of God, labour controversy, civil disturbance, war (whether or not officially declared) or the inability to obtain sufficient supply of service, transportation, or other essential commodity or service required in the conduct of its business, or any change in or the adoption of any law, regulation, judgment or decree. Without limiting the foregoing, under no circumstances shall panind.com be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning of your information and or data received and or stored or any of our service/s.

Safety Of Data Downloaded
The User understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

Nevertheless, PAYKAR.IO will always make its best endeavors to ensure that the content on its websites or other information channels are free of any virus or such other malwares.

Feedback From Customer And Solicitation:
The User is aware that PAYKAR provides various services like hotel bookings, car rentals, holidays and would like to learn about them, to enhance his / her travel experience. The User hereby specifically authorizes PAYKAR to contact the User with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case that the customer chooses not to be contacted, he /she shall write to PAYKAR for specific exclusion at [email protected] or provide his / her preferences to the respective service provider. The customers are advised to read and understand the privacy policy of PAYKAR.IO on its website in accordance of which PAYKAR.IO contacts, solicits the user or shares the user’s information.

Proprietary Rights
PAYKAR.IO may provide the User with contents such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws.

The User may use this material only as expressly authorized by PAYKAR.IO and shall not copy, transmit or create derivative works of such material without express authorization.

The User acknowledges and agrees that he/she shall not upload post, reproduce, or distribute any content on or through the Services that is protected by copyright or other proprietary right of a third party, without obtaining the written permission of the owner of such right.

Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

Visa Obligations Of The User
The travel bookings done by PAYKAR.IO are subject to the applicable requirements of Visa which are to be obtained by the individual traveller. PAYKAR.IO is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason.

Personal And Non-Commercial Use Limitation
Unless otherwise specified, the PAYKAR.IO services are for the User’s personal and non – commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the PAYKAR.IO website(s) without the express written approval from PAYKAR.IO.

Indemnification
The User agrees to indemnify, defend and hold harmless PAYKAR.IO and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by PAYKAR.IO and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and PAYKAR.IO cannot be held responsible for the same.

Right To Refuse
PAYKAR.IO at its sole discretion reserves the right to not to accept any customer order without assigning any reason thereof. Any contract to provide any service by PAYKAR.IO is not complete until full money towards the service is received from the customer and accepted by PAYKAR.IO.

Without prejudice to the other remedies available to PAYKAR.IO under this agreement, the TOS or under applicable law, PAYKAR.IO may limit the user’s activity, or end the user’s listing, warn other users of the user’s actions, immediately temporarily/indefinitely suspend or terminate the user’s registration, and/or refuse to provide the user with access to the website if:

• The user is in breach of this agreement, the TOS and/or the documents it incorporates by reference;
• PAYKAR.IO is unable to verify or authenticate any information provided by the user; or
• PAYKAR.IO believes that the user’s actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or PAYKAR.IO.

PAYKAR.IO may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with PAYKAR.IO or use the website in any manner whatsoever until such time that the user is reinstated by PAYKAR.IO.

Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, PAYKAR.IO reserves the right to recover any amounts due and owing by the user to PAYKAR.IO and/or the service provider and to take strict legal action as PAYKAR.IO deems necessary.

Right To Cancellation By Paykar.io In Case Of Invalid Infromation From User
The User expressly undertakes to provide to PAYKAR.IO only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from PAYKAR.IO.

In case PAYKAR.IO discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, PAYKAR.IO in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, PAYKAR.IO shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.

The User unequivocally indemnifies PAYKAR.IO of any such claim or liability and shall not hold PAYKAR.IO responsible for any loss or damage arising out of measures taken by PAYKAR.IO for safeguarding its own interest and that of its genuine customers. This would also include PAYKAR.IO denying/cancelling any bookings on account of suspected fraud transactions.

Interpretation Number And Gender
The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form. The words “include”, “includes” and “including” shall be deemed to be followed by the phrase “without limitation”. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, ‘hereunder” and words of similar import refer to this agreement as a whole.

Severability
If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Headings
The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of PAYKAR.IO Websites or its partner websites or any provision hereof in any manner whatsoever.

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular PAYKAR.IO website, then these terms shall control.

Relationship
None of the provisions of any agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of PAYKAR.IO Websites or its partner websites, shall be deemed to constitute a partnership between the User and PAYKAR.IO and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.

Updation Of The Information By Paykar.io
User acknowledges that PAYKAR.IO provides services with reasonable diligence and care. It endeavors its best to ensure that User does not face any inconvenience. However, at some times, the information, software, products, and services included in or available through the PAYKAR.IO websites or other sales channels and ad materials may include inaccuracies or typographical errors which will be immediately corrected as soon as PAYKAR.IO notices them. Changes are/may be periodically made/added to the information provided such. PAYKAR.IO may make improvements and/or changes in the PAYKAR.IO websites at any time without any notice to the User. Any advice received except through an authorized representative of PAYKAR.IO via the PAYKAR.IO websites should not be relied upon for any decisions.

EDUCATION FEE TERMS & CONDITIONS
i. Role: Any registered User of the Platform may choose to make Tuition Fee, School Fees, Education Fees, or College Fee through the payment gateway(s) authorized by PAYKAR. In this regard, the Users are asked to provide customary billing information such as name, and financial instrument information which shall include the bank account number, IFSC code of the Receiver, UPI ID of the Receiver, Name of the Receiver to whom the payment has to be made. Users may also be asked to provide a copy of the Fee Bill, Student ID Card pursuant to which such education fee payments are being made. The Users must provide accurate, current, and complete information while making the payment through the Platform/App and it shall be the User’s obligation to keep this information up-to-date at all times. The Users are solely responsible for the accuracy and completeness of the information provided by them and PAYKAR shall not be responsible for any loss suffered by the User as a result of any incorrect information, including payment information provided by the Users.

Except for PAYKAR’s limited role in processing the payments that registered Users authorize or initiate, PAYKAR is not involved in any underlying transaction between the User, any other User, any third person or any service providers. PAYKAR is not a bank and does not offer any banking or related services. PAYKAR may use the services of one or more third parties (each a “Processor”) to provide the Service and process the User’s transactions. Further, PAYKAR does not guarantee payment on behalf of any registered User, other User or Processor and explicitly disclaims all liability for any act or omission of any User or Processor. PAYKAR is neither an agent of the lessor or lessee or any registered User. PAYKAR acts solely as an intermediary which facilitates payments between the registered Users making the payment and the intended third-party beneficiaries.

1. Authorization: The User acknowledges that PAYKAR is authorized by the User to hold, receive and disburse funds in accordance with the User’s payment instructions provided through the Platform for the purposes of facilitating the transfer of monies to the intended beneficiary as specified by the User on the Platform . [The authorization given by the Users permits PAYKAR (a) to debit or credit the User’s balance, bank account, any credit card, debit card, or other payment cards or any other payment method that PAYKAR accepts] or (b) to process payment transactions that the Users authorize by generating an electronic funds transfer. [By instructing PAYKAR to pay another User, the Users authorize and order PAYKAR to make the payments (less any applicable fees or other amounts we may collect under this Agreement) to such user. PAYKAR may limit the recipient’s ability to use or withdraw the committed funds for such period of time that PAYKAR has agreed to with the recipient.]

iii. Fees: The User agrees that they may be charged a service charge by PAYKAR for using the Platform to make education payments

1. Transaction Limits: PAYKAR may delay, suspend or reject a transaction for any payment(s) for any reason, including without limitation if PAYKAR suspects that the transaction subjects it to financial or security risk or is unauthorized, fraudulent, suspicious, unlawful, in violation of the terms of this Agreement subject to dispute or otherwise unusual.
2. Fraud and restrictions: PAYKAR may ask for additional documents (like Fee Bill, Student ID Card, Sender’s PAN, and Sender’s Aadhar) where it deems necessary, including in case the transaction looks suspicious. [PAYKAR will refund the full amount (excluding the nominal processing fees collected by PAYKAR) without any deductions if PAYKAR determines it is not a valid education fee payment or if such payment is fraudulent. A valid education fee payment is one where there exists a legally valid Student ID Card and Fees Bill Issued by Education Institute/ Teacher between the institution and the Student/parent with the fee amount equivalent to what is being transferred on PAYKAR. A valid education fee payment is one where there exists a fee bill between the payer and the receiver.
3. Liability: The Users agree not to hold PAYKAR responsible and/or liable for any issue or claim arising out of any dispute whatsoever between the User and the Processor and/or the User and the User’s bank or financial institution. Further, The Users agree not to hold PAYKAR responsible and/or liable for any delay in service up to a maximum of 7 working days.

Additionally, please note that PAYKAR shall not be responsible for any additional fees or charges deducted by the Processors while processing payments in connection with the User’s transaction and PAYKAR disclaims all liability in this regard. Further, the Users may also be subject to additional terms and conditions imposed by such Processors and the Users should review these terms and conditions before authorizing any payments through the Processors.

vii. Chargebacks: The amount of a transaction may be charged back or reversed to the User (a “Chargeback”) if the transaction (a) is disputed by the sender, (b) is reversed for any reason, (c) was not authorized or PAYKAR has reason to believe that the transaction was not authorized, or (d) is allegedly unlawful, suspicious, or in violation of the terms of this Agreement. The Users owe PAYKAR and will immediately pay PAYKAR the amount of any Chargeback and any associated fees, fines, or penalties assessed by PAYKAR’s Processor, processing financial institutions, or MasterCard, Visa, American Express, Discover, and other payment card networks, associations, or companies (“Networks”). The Users agree to assist PAYKAR when requested, at the User’s expense, to investigate any of the User’s transactions processed through the Service. For Chargebacks associated with cards, PAYKAR will work with the Users to contest the Chargeback with the Network or issuing banks should the User choose to contest the Chargeback. In this regard, PAYKAR will request necessary information from the User to contest the Chargeback and the User’s failure to timely assist PAYKAR in investigating a transaction, including without limitation providing necessary documentation within 3 business days of PAYKAR’s request, may result in an irreversible Chargeback.

viii. Refunds: [In case, PAYKAR is not able to facilitate the transfer of the education fee amount to the beneficiary account due to any technical difficulties, PAYKAR will initiate the refund payment back to the source within 1-7 business days.] The Users are advised not to transfer the amount directly to the beneficiary until a refund ID is generated and sent to the Users through email or SMS.

1. The Users acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of the User’s access to and use of the payment Services remains with the Users. If the Users permit or authorize another person to use their PAYKAR account in any way, the Users shall be responsible for the actions taken by that person. Neither PAYKAR nor any other party or Processor involved in creating, producing, or delivering the payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these payments terms.

RENT PAY TERMS & CONDITIONS
i. Role: Any registered User of the Platform may choose to make rent payments, maintenance payments and payment of security deposit/ token amounts, through the payment gateway(s) authorized by PAYKAR. In this regard, the Users are asked to provide customary billing information such as name, financial instrument information which shall include the bank account number, IFSC code of the Receiver, UPI ID of the Receiver, Name of the Receiver to whom the payment has to be made. Users may also be asked to provide a copy of the rental agreement pursuant to which such rent payments are being made. The Users must provide accurate, current, and complete information while making the payment through the Platform/App and it shall be the User’s obligation to keep this information up-to-date at all times. The Users are solely responsible for the accuracy and completeness of the information provided by them and PAYKAR shall not be responsible for any loss suffered by the User as a result of any incorrect information, including payment information provided by the Users.

Except for PAYKAR’s limited role in processing the payments that registered Users authorize or initiate, PAYKAR is not involved in any underlying transaction between the User, any other User, any third person or any service providers. PAYKAR is not a bank and does not offer any banking or related services. PAYKAR may use the services of one or more third parties (each a “Processor”) to provide the Service and process the User’s transactions. Further, PAYKAR does not guarantee payment on behalf of any registered User, other User or Processor and explicitly disclaims all liability for any act or omission of any User or Processor. PAYKAR is neither an agent of the lessor or lessee or any registered User. PAYKAR acts solely as an intermediary which facilitates payments between the registered Users making the payment and the intended third-party beneficiaries.

Authorization: The User acknowledges that PAYKAR is authorized by the User to hold, receive and disburse funds in accordance with the User’s payment instructions provided through the Platform for the purposes of facilitating the transfer of monies to the intended beneficiary as specified by the User on the Platform. [The authorization given by the Users permits PAYKAR (a) to debit or credit the User’s balance, bank account, any credit card, debit card, or other payment cards or any other payment method that PAYKAR accepts] or (b) to process payment transactions that the Users authorize by generating an electronic funds transfer. [By instructing PAYKAR to pay another User, the Users authorize and order PAYKAR to make the payments (less any applicable fees or other amounts we may collect under this Agreement) to such user. Additionally, please note that PAYKAR shall not be responsible for any additional fees or charges deducted by the Processors while processing payments in connection with the User’s transaction and PAYKAR disclaims all liability in this regard. Further, the Users may also be subject to additional terms and conditions imposed by such Processors and the Users should review these terms and conditions before authorizing any payments through the Processors.

vii. Fraud and restrictions: PAYKAR may ask for additional documents (like Rental Agreement, Owner/Tenant PAN, Maintenance Bill, Sender’s PAN, and Sender’s Aadhar) where it deems necessary, including in case the transaction looks suspicious. [PAYKAR will refund the full amount (excluding the nominal processing fees collected by PAYKAR) without any deduction if PAYKAR determines it is not a valid rent/token/security deposit/ maintenance payment or if such payment is fraudulent. A valid rent/security deposit payment is one where there exists a legally valid rental agreement between the tenant and the landlord with the rent amount equivalent to what is being transferred on PAYKAR. A valid maintenance payment is one where there exists a maintenance bill between the payer and the society/RWA.

viii. Refunds: [In case, PAYKAR is not able to facilitate transfer the rent amount to the beneficiary account due to any technical difficulties, PAYKAR will initiate the refund payment back to the source within 1-7 business days.] The Users are advised not to transfer the rent directly to the landlord until a refund ID is generated and sent to the Users through email and SMS.

Bus Tickets
PAYKAR.IO is only a bus ticket agent. It does not operate buses or offers bus transport services. In order to provide a comprehensive choice of bus operators, departure times and prices to customers, PAYKAR.IO has tied up with many bus operators and service providers. PAYKAR.IO’s advice to customers is to choose the bus operators who they are aware of and whose service they are comfortable with. PAYKAR.IO’s responsibilities include:

• issuing a valid ticket (a ticket that will be accepted by the bus operator) for its network of bus operators;
• providing support in the event of cancellation; and
• providing customer support and information in case of any delays/inconvenience.
• IO’s responsibilities do not include:
• The bus operator’s bus not departing/reaching on time;
• The bus operator’s employees being unprofessional or engaging in unlawful conduct;
• The bus operator’s bus seats, etc., not being up to the customer’s expectation;
• The bus operator cancelling the trip due to any reason;
• The baggage of the customer getting lost/stolen/damaged;
• The bus operator changing a customer’s seat at the last minute to accommodate any of the following passengers: senior citizens, children, pregnant women, persons with disability or any other person in a situation of emergency;
• The customer waiting at the wrong boarding point (please call the bus operator to find out the exact boarding point if User are not a regular traveller on that particular bus or route);
• The bus operator changing the boarding point and/or using a pick-up vehicle at the boarding point to take customers to the bus departure point.
• The arrival and departure times mentioned on the ticket are only tentative timings. However, the bus will not leave the source before the time that is mentioned on the ticket.

Passengers are required to furnish the following at the time of boarding the bus:

• A copy of the ticket (a printout of the ticket or the printout of the ticket e mail).
• Identity proof (Aadhaar Card, Driving license, Student ID card, Company ID card, Passport, PAN card or Voter ID card). Failing to do so, they may not be allowed to board the bus.

Passengers must also be aware of the following :

• Change of bus: In case the bus operator changes the type of bus due to some reason, PAYKAR.IO has no role in governing the cancellation/differential charges.
• Cancellation Policy: Passengers are expected to read the ticket cancellation policy carefully. Tickets will be cancelled as per the cancellation policy linked with the ticket. The transaction charges will not be refunded in the event of ticket cancellation.
• Refund policy mentioned on the ticket is indicative. The actual cancellation charges are determined by bus operators and bus providers at the actual time of cancellation. PAYKAR.IO has no role in governing the cancellation charges.
• Cancellation charges are calculated on the actual fare of the ticket. If any discount coupons are used while purchasing the ticket, the discounted value would be used to calculate the refund amount when a ticket is cancelled.
• In case a booking confirmation e mail and SMS gets delayed or fails because of technical reasons or as a result of incorrect e mail ID/phone number provided by the user, etc., a ticket will be considered ‘booked’ as long as the ticket shows up on the confirmation page of the PAYKAR.IO Platform.
• Amenities on the buses as shown on PAYKAR.IO have been configured and provided by the bus service provider (bus operator). These amenities will be provided unless there are some exceptions on certain days. Please note that PAYKAR.IO provides this information in good faith to help passengers to make an informed decision. Provision of video, air conditioning and any such other services mentioned by PAYKAR.IO’s travel partners in the buses is their own responsibility. Any refunds/claims due to non-functioning or un-availability of these services needs to be settled directly with the bus service provider.
• IO is not responsible for any kind of journey inconvenience, injury or death, caused during the journey or flowing from the journey.
• For any issues relating to cancellation or refund, the passenger may contact PAYKAR.IO within 5 days of date of travel, beyond which period request would not be processed.
• IO may call the mobile phone number provided by User while registering with the PAYKAR.IO Platform, or any updated mobile number subsequently provided by User on the PAYKAR.IO Platform, or contact User via e-mail, for the purpose of collecting feedback from User regarding Your travel bookings, including but not limited to the bus facilities and/or services of the bus operator.
• Grievances and claims related to the bus journey should be reported to PAYKAR.IO support team within 5 days of Your travel date.

Modification Of These Terms Of Use
PAYKAR.IO reserves the right to change the terms, conditions, and notices under which the PAYKAR.IO websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.

Jurisdiction
PAYKAR.IO hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. PAYKAR.IO considers itself and intends to be subject to the jurisdiction only of the courts of GHAZIABAD UTTAR PRADESH, India.

Responsibilities Of User Vis-A-Vis The Agreement
The User expressly agrees that use of the services is at their sole risk. To the extent PAYKAR.IO acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the standards of services provided by the service providers. In no circumstances shall PAYKAR.IO be liable for the services provided by the service provider. The services are provided on an “as is” and “as available” basis. PAYKAR.IO may change the features or functionality of the services at any time, in their sole discretion, without notice. PAYKAR.IO expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, which the User obtains from PAYKAR.IO or through the services shall create any warranty not expressly made herein or in the terms and conditions of the services. If the User does not agree with any of the terms above, they are advised not to read the material on any of the PAYKAR.IO pages or otherwise use any of the contents, pages, information or any other material provided by PAYKAR.IO. The sole and exclusive remedy of the User in case of disagreement, in whole or in part, of the user agreement, is to discontinue using the services after notifying PAYKAR.IO in writing.
